FTC files reply in Phoebe Case

ALBANY, GA -- The Federal Trade Commission has filed a reply in the case to block Phoebe Putney Memorial Hospital from purchasing Palmyra Park.
The FTC filed a brief in the United States 11th Circuit Court of Appeals. Their brief states that if the transaction to merge Phoebe Putney with Palmyra, would lead to a healthcare monopoly in southwest Georgia.
The brief states "t
his case is about a private merger to monopoly masquerading as governmental action. This Court should recognize it as such, and take immediate action to ensure the Commission’s ability to issue an effective administrative order."
The brief concludes stating that the Court should reverse the U.S. district court for the Middle District of Georgia and issue a preliminary injunction requiring both hospitals to maintain their current status quo during the administrative proceedings.
