By a 4-3 opinion, the court upheld a prior ruling by the Georgia Court of Appeals that threw out the October 2005 conviction of James Odell Hobbs
ATLANTA -- The Georgia Supreme Court has overturned a rape conviction against a Cherokee County man.
The court ruled that the trial judge gave insufficient instructions to the jury, reported the Atlanta Journal-Constitution.
The court upheld a prior ruling by the Georgia Court of Appeals that threw out the October 2005 conviction of James Odell Hobbs.
Hobbs had been found guilty on several charges including rape, aggravated child molestation, aggravated sexual battery, and cruelty to children. He received a prison sentence of 20 years.
