FTC lifts stay on Phoebe Putney hearing

After the Supreme Court ruled in February that the lower courts improperly dismissed the case, the Federal Trade Commission announced on Friday that the stay has been lifted and they will begin the process of scheduling a hearing against Phoebe Putney Memorial Hospital

ALBANY --
In 2011, the Federal Trade Commission put a hold on an administrative hearing regarding the Phoebe Putney Memorial Hospital and Palmyra Hospital merger pending the Supreme Court’s decision on whether or not the case would continue.

After the Supreme Court ruled in February that the lower courts improperly dismissed the case, the FTC announced on Friday that the stay has been lifted.

Phoebe officials were notified and general counsel Tommy Chambless released the following statement,

Our attorneys have been notified of the order to lift the stay. This was expected as a part of this process. Matters now move into a resumption of the discovery process in preparation for a hearing. We look forward to demonstrating the substantial benefits that have accrued and will accrue to the community we serve as a result of this acquisition by the Authority.”

The FTC states they will begin the process of scheduling a new hearing at a date that is practicable but no later than July 15th.
