The Georgia Supreme Court reverses a habeas court's ruling in the 1988 case of a Crisp Co. man who pled guilty to drug charges

CRISP COUNTY, GA --
The Georgia Supreme Court reversed a lower court’s ruling in the case of a Crisp County man charged in 1988 with violating the Georgia Controlled Substances Act.

Stacy Fullwood was 20 years old in 1988 when he pled guilty on possession of cocaine with intent to distribute. He was sentenced under the Georgia First Offender Act to 10 years on probation.

Fast forward 20 years later: Fullwood files a “writ of habeas corpus” petition saying he was denied right to counsel at his plea hearing because he did not “voluntarily and knowingly” wave that right. Habeas court denied the petition but recently the Georgia Supreme Court reversed the ruling.
