The Terrell County sheriff is appealing a five day sentence in jail.

Sheriff John Bowens and his lawyer filed an appeal Friday. Last week, Judge Dane Perkins sentenced Bowens to five days for contempt of court. In February, Judge Ronnie Joe Lane held Bowens in contempt for not bringing four inmates to court—disobeying a court order. Bowens says he didn’t have the staffing to safely transport the inmates, but it wasn’t an excuse for Lane. The two men faced off at a hearing April 30.

Bowens’ lawyer says they’re now waiting to hear from the Court of Appeals.
