ATLANTA, GA -- The State of Georgia was denied in their attempt  to expedite the appeal motion of convicted murderer Warren Lee Hill.

Hill was sentenced to die by lethal injection but filed an appeal regarding the Department of Corrections' change in the lethal injection protocol.

With the denial handed down by the Supreme Court of Georgia, Hill's case will be argued in November.
