ALBANY, GA. --
A grand jury has issued an indictment for a man accused of child cruelty.

Dougherty County court records show Phillip Lamar Davis allegedly went to Merry Acres Middle School on November 17th and caused excessive physical pain to a boy he has guardianship over.

Davis is accused of punching the child in the face, placing him in a choke hold and slamming him to the ground.

Officials also say once the two left the school, another incident occurred where Davis is accused of kicking the child in the back and stomach.

“What was important about this matter while the law does allow discipline in an appropriate manner, when you go beyond that constitutes the crime of cruelty to children in the first degree,” says Dougherty County District Attorney Greg Edwards.

Edwards says the incident was reported to authorities immediately and Dougherty County School Police made the arrest.

Phillip Davis is charged with two counts of child cruelty.
