ALBANY, GA -- A case of mistaken identity sets one Albany man free and lands another behind bars.

30-year-old Gregory Spann was arrested on October 30th for the beating death of 54-year-old Frankie Carr – a homeless man.

Spann was in the area where the murder occurred and was wearing clothing that matched an eyewitness description.

31-year-old LaDerick Chappel was arrested in Atlanta on November 12th for the same murder and transported to the Dougherty County Jail.

Albany police did not say what evidence led to Chappel’s arrest.
