ALBANY, GA -- A case of mistaken identity sets one Albany man free and lands another behind bars.

30-year-old Gregory Spann was arrested on October 30^th for the beating death of 54-year-old Frankie Carr – a homeless man.

Spann was in the area where the murder occurred and was wearing clothing that matched an eyewitness description.

31-year-old LaDerick Chappel was arrested in Atlanta on November 12^th for the same murder and transported to the Dougherty County Jail.

Albany police did not say what evidence led to Chappel’s arrest.
