Former Assistant Fire Chief Roderick Jolivette has filed a federal lawsuit against the city of Albany and Fire Chief James Carswell.

Court documents show Jolivette claims he was illegally bypassed for a promotion due to racial discrimination. Jolivette contends that his 14th amendment rights were violated after he was reinstated following an investigation into possible misuse of city property. Jolivette is seeking both punitive and compensatory damages based on the lost wages and mental anguish he says he's suffered as a result of the city's actions. The city has not answered Jolivette's suit which was filed April 29, 2010.
